Respondents, Mexican nationals, were arrested by
Immigration and Naturalization Service agents and deported. Respondents were
later arrested in the United States and were charged with violating 8 U.S.C.S.
§ 1326, which criminalized illegal re-entry into the United States after
deportation. The circuit court of appeals affirmed both the district court's
ruling that respondents could collaterally attack the previous deportation
orders and its dismissal of the indictments because respondents did not make
knowing and intelligent waivers of their rights to apply for suspension of
deportation or to appeal. The Court affirmed, holding that neither the language
of § 1326 nor its legislative history provided for a challenge to the validity
of the underlying deportation order. The Court further held that the right to
due process required that judicial review of an administrative proceeding must
be made available before the proceeding may be used to establish conclusively
an element of a criminal offense. Because respondents were deprived of their
rights to appeal, the deportation proceedings could not be used to support a
criminal conviction, and the dismissal of the indictments was proper.<o:p></o:p></div>

Respondent alien was apprehended for entering the United
States without inspection. Petitioner Immigration and Naturalization Service
brought deportation proceedings, during which respondent sought asylum pursuant
to § 208(a) of the Immigration and Nationality Act, 8 U.S.C.S. § 1158(a). The
immigration judge and the Board of Immigration Appeals (BIA) rejected the
asylum claim. The court of appeals reversed the decisions, holding that a
guerilla organization's attempt to coerce respondent into performing military
service necessarily constituted persecution on account of political opinion
under § 101(a)(42) of the Act, 8 U.S.C.S. § 1101(a)(42). The Supreme Court
reversed and determined that the BIA decision should have been upheld. First,
the record demonstrated that respondent did not have a political motive for
resisting recruitment by the guerillas. Second, in finding a danger of
persecution on account of political opinion, the court of appeals had
improperly concluded that persecution was threatened on account of the guerillas'
political opinion, rather than respondent's political opinion as required by §
101(a)(42).<o:p></o:p></div>

An applicant may satisfy the subjective element by presenting candid, credible, and sincere testimony demonstrating a genuine fear of persecution. The objective element requires the asylum petitioner to show, with specific, concrete facts, that a reasonable person in like circumstances would fear persecution.<o:p></o:p></li>
<li class="MsoNormal" style="line-height: 24px; text-align: justify;">In amending the Immigration and Nationality Act, 8 U.S.C.S. § 1101 (a)(42), Congress included three additional classes of individuals in the definition of "refugee": 1) persons who had been forced to undergo an involuntary sterilization or abortion; 2) persons who had been persecuted for refusing to undergo such a procedure or for other resistance to a coercive population control program; and 3) persons who have a wellfounded fear of being subjected to a coercive population control program.</li>
