The
Virginia Court made the following holding:
- As defined by the
Immigration and Nationality Act, a refugee is an alien unable or unwilling
to return to his home country because of persecution or a well-founded
fear of persecution on account of race, religion, nationality, membership
in a particular social group, or political opinion. 8 U.S.C.S. §
1101(a)(42)(A).
- A Board of Immigration Appeal determination of ineligibility for asylum will be upheld if supported by reasonable, substantial, and probative evidence on the record considered as a whole. 8 U.S.C.S. § 1105a(a)(4) (1996). The possibility of drawing two inconsistent conclusions from the evidence does not prevent an administrative agency's finding from being supported by substantial evidence. Indeed, the Board of Immigration Appeal's determination that an alien is not eligible for asylum must be upheld unless the alien shows that the evidence presented was so compelling that no reasonable factfinder could fail to find the requisite fear of persecution.
