Facts:

            Defendant pled guilty to having been illegally in the United States following deportation for felony convictions. The district court applied 8 U.S.C.S. § 1326 in sentencing him and the United States Court of Appeals affirmed. Defendant was granted a writ of certiorari, arguing that he should not have received an enhanced sentence because the indictment failed to disclose his prior convictions.

            The Federal Court made the following holding:

  • 8 U.S.C.S. § 1326(a) defines a crime. It forbids an alien who once was deported to return to the United States without special permission, and it authorizes a prison term of up to, but no more than, two years. Section 1326(b)(2) authorizes a prison term of up to, but no more than, 20 years for any alien described in § 1326(a), if the initial deportation was subsequent to a conviction for commission of an aggravated felony.
