Facts:
Petitioner applicant sought review of judgment from the
United States Court of Appeals for the Fourth Circuit, which held that
petitioner's willful misrepresentations as to his date and place of birth were
material misrepresentations under 8 U.S.C.S. § 1451(a) and that the material
misrepresentations resulted in petitioner's illegally procuring citizenship under
8 U.S.C.S. § 1101(f)(6).

Virginia Court made the following holding:
- 8 U.S.C.S. § 1451(a) provides for the denaturalization of citizens whose citizenship orders and certificates of naturalization were procured by concealment of a material fact or by willful misrepresentation. Courts have previously suggested that this requires misrepresentations or concealments that are both willful and material. So understood, the provision plainly contains four independent requirements: the naturalized citizen must have misrepresented or concealed some fact, the misrepresentation or concealment must have been willful, the fact must have been material, and the naturalized citizen must have procured citizenship as a result of the misrepresentation or concealment..
